Platform Terms of Service
Effective date: July 26, 2026. These Terms of Service ("Terms") are a binding agreement between Galactic Holdings LLC, a Colorado limited liability company, doing business as TowGether ("TowGether," "we," "us"), and each person who creates an account or uses the TowGether website or apps (the "Platform").
IMPORTANT: Section 12 contains a binding arbitration provision and class action waiver that affect your legal rights. Please read it.
1. Acceptance
You accept these Terms by checking the acceptance box at account creation or booking. We keep a record of the version you accepted, your account, and the timestamp. If you do not agree, do not use the Platform.
2. TowGether Is a Venue Only
The Platform lets users find each other and transact directly. TowGether does not own, rent, inspect, maintain, store, or operate trailers; does not transport goods; does not provide storage; is not a party to user-to-user agreements; and is not a motor carrier, freight broker, freight forwarder, or household goods mover. Owners, Haulers, and Hosts are independent third parties, not our employees, agents, or contractors. Any verification we perform (identity, insurance, credentials) is a limited screening aid, not an endorsement or guarantee.
3. Accounts and Eligibility
- You must be 18 or older and able to form a binding contract.
- You consent to identity verification and, where applicable to your role, driver's license, insurance, vehicle, and DOT-credential checks, including via third-party services and the FMCSA SAFER database.
- You are responsible for the accuracy of information and documents you submit and for keeping them current. Submitting false documents is grounds for immediate termination and may be reported.
4. User Roles
Owner (lists a trailer for rental), Renter (rents and tows a trailer), Hauler (offers paid pickup, hauling, and delivery services), Customer (hires a Hauler), Host (licenses space for trailer storage), and Storer (stores a trailer with a Host). Role-specific agreements apply in addition to these Terms and are incorporated by reference: Trailer Rental Agreement, Hauling Service Agreement, Storage License Agreement, and Hauler Onboarding Agreement.
5. Bookings, Payments, Deposits, and Fees
- Payments are processed by our payment provider (Stripe). You agree to Stripe's terms. We never store full card numbers.
- Booking funds are held and released per the applicable role agreement (e.g., owner payout after clean pickup; hauler payout upon confirmed delivery).
- Security deposits, where an owner or host requires one, are set and administered between the parties per the applicable role agreement — TowGether does not hold deposit funds. Deposits may be claimed only for documented damage, loss, fees, tolls, or fines supported by the booking's photo and message record.
- Cancellations and refunds: Rentals — full refund if cancelled 48+ hours before the booking starts; 50% within 48 hours; no refund once the booking has started. Storage — full refund if cancelled 7+ days before a block starts; 50% within 7 days; no refund once a block starts (paid-through dates are always honored). Hauling — full refund 24+ hours before the scheduled job; 50% within 24 hours. Purchases — cancellable until the seller accepts; after acceptance, refunds only by mutual agreement before pickup. Approved refunds are executed by TowGether through the payment provider to the original payment method.
- TowGether charges the service fees displayed at checkout and may change fee schedules prospectively.
- Off-platform payment for bookings initiated on the Platform is prohibited and forfeits all Platform protections.
6. Protection Plans Are Not Insurance
Optional protection plans offered at checkout are contractual damage waivers between you and TowGether unless expressly identified as an insurance product underwritten by a licensed insurer. Waivers modify liability between the parties; they are not insurance policies, and they exclude the items listed in the plan terms (including liability to third parties and bodily injury unless expressly stated).
7. User Conduct
You agree not to: misrepresent yourself, your equipment, or your credentials; list property you do not own or control; transport or store hazardous materials, illegal goods, firearms, people, or animals under a booking; use a trailer or space beyond its stated limits; circumvent fees; scrape or misuse the Platform; or harass other users. We may remove listings, withhold payouts pending investigation, and suspend or terminate accounts for violations.
8. Insurance Responsibilities
- Renters warrant their auto liability policy extends to towed trailers or that they have otherwise obtained legally required coverage.
- Haulers warrant they carry auto liability and, where applicable, cargo insurance and any FMCSA/state-mandated minimums for their operations, and that credentials on file remain current.
- Owners and Hosts are responsible for insuring their own property. TowGether provides no insurance to any user except as expressly stated in a written plan.
9. Assumption of Risk and Release
Trailer towing, hauling, loading, and storage involve inherent risk. To the maximum extent permitted by law, you assume those risks and release TowGether and its officers, employees, and agents from claims arising out of the acts or omissions of other users, including property damage, cargo damage, bodily injury, and economic loss. This release does not apply to liability that cannot be waived by law, including liability arising from our own gross negligence or willful misconduct.
10. Indemnification
You will defend, indemnify, and hold harmless TowGether from claims, damages, fines, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your breach of these Terms or a role agreement, your violation of law, or your infliction of harm on any third party, except to the extent caused by our gross negligence or willful misconduct.
11. Disclaimers; Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOWGETHER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM IS LIMITED TO THE GREATER OF (A) TOTAL SERVICE FEES YOU PAID TO TOWGETHER IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Some states do not allow certain limitations; those limitations apply only to the extent permitted where you live.
12. BINDING ARBITRATION AND CLASS ACTION WAIVER
Please read carefully — this section affects your rights. Any dispute arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court or seek injunctive relief for intellectual-property misuse. Arbitration will take place in your county of residence or remotely by video. You and TowGether each waive the right to a jury trial and the right to participate in a class action. You may opt out of this arbitration provision by emailing support@towgether.com within 30 days of first accepting these Terms. This section applies to both parties equally and survives termination.
13. Termination
You may close your account at any time; obligations from completed or in-progress bookings survive. We may suspend or terminate accounts that violate these Terms, present safety risks, or fail verification.
14. General
These Terms are governed by the laws of the State of Colorado, excluding conflicts rules, except that the Federal Arbitration Act governs Section 12. If a provision is unenforceable, the remainder stands. We may update these Terms prospectively with notice; continued use is acceptance. Notices go to your account email.
