Trailer Purchase Agreement & Bill of Sale
This Trailer Purchase Agreement and Bill of Sale ("Agreement") is entered into between the Seller and the Buyer identified below. It is generated per transaction through the TowGether platform and incorporates the TowGether Terms of Service, including its arbitration provision. TowGether is not a party to this Agreement and does not own, inspect, or warrant the Trailer.

- Deposit paid through platform / balance due
- Pickup location and date
1. Sale and Payment Through the Platform
Seller agrees to sell and Buyer agrees to buy the Trailer described above for the purchase price stated. Payment is processed through the TowGether platform. Funds are held and released to Seller only after both parties complete the pickup confirmation. Off-platform payment for a transaction initiated on the platform is prohibited and forfeits all platform protections, including payment protection and dispute support.
2. Condition, Inspection, and "AS-IS" Sale
Buyer has the right to inspect the Trailer at pickup, including frame, tires, bearings, coupler, lights, brakes (if fitted), floor, and VIN. Except as expressly stated in the listing or in writing, the Trailer is sold "AS-IS, WHERE-IS," with all faults and without warranty of any kind, express or implied, including merchantability or fitness for a particular purpose. Seller warrants only that: (a) Seller has good title and full authority to sell; (b) the Trailer is free of undisclosed liens and encumbrances; and (c) the VIN and description above are accurate.
3. Photo Record at Pickup
Both parties must complete the platform photo walk-around at handover, documenting overall condition, VIN plate, and any disclosed defects. The pickup record is conclusive evidence of the condition at transfer absent manifest error. Buyer's confirmation at pickup releases payment to Seller and completes the sale.
4. Title, Registration, and Taxes
Seller shall deliver at pickup: the signed-over certificate of title (or, where the Trailer is exempt or title is unavailable, this executed Bill of Sale and any available registration), and any keys, locks, or manuals. Buyer is responsible for registering the Trailer, paying applicable sales/use tax, and any title-transfer fees in Buyer's state, within the period required by law. For Trailers sold without a title, Buyer acknowledges the risks stated in the listing and that registration may require a bonded-title or equivalent process in Buyer's state [STATE-SPECIFIC PROCESS — ATTORNEY TO COMPLETE].
5. Risk of Loss and Transfer of Ownership
Ownership and risk of loss pass to Buyer upon completion of the pickup confirmation and release of funds. From that moment, Buyer is responsible for insurance, towing legality (hitch class, lighting, brakes where required), and compliance with all laws.
6. Deposits, Cancellation, and Default
If the listing provided for a deposit, the deposit is held through the platform and applied to the purchase price at pickup. If Buyer fails to appear or declines the Trailer at pickup for reasons other than material misdescription or an undisclosed lien or defect, the deposit is released to Seller as liquidated damages. If Seller fails to deliver the Trailer as described, all funds are returned to Buyer.
7. No Odometer/Weight Certification by Platform
Any mileage, weight, or capacity figures are provided by Seller. TowGether does not verify them. [Include odometer disclosure only if applicable to the trailer type and jurisdiction — ATTORNEY TO CONFIRM.]
8. Indemnification
Buyer shall indemnify and hold harmless Seller from claims arising from Buyer's use, towing, or ownership of the Trailer after transfer. Seller shall indemnify and hold harmless Buyer from claims arising from Seller's ownership or use before transfer, from breach of the title warranty in Section 2, and from any undisclosed lien.
9. Disputes
Disputes are handled first through the platform resolution process, then per the arbitration provision of the Terms of Service. This Agreement is governed by the laws of the state where the Trailer is picked up.
Signatures. The parties sign electronically through the platform; the platform's e-signature record (name, account, timestamp, IP) is binding under the E-SIGN Act and applicable state law.
Seller and Buyer signature blocks are completed in the per-transaction copy of this agreement.
