Trailer Rental Agreement

This Trailer Rental Agreement (“Agreement”) is entered into between the Owner and the Renter identified below. It is generated per booking through the TowGether platform and incorporates the TowGether Terms of Service, including its arbitration provision. TowGether is not a party to this Agreement.

Booking Details

The following details are completed per booking through the platform:

  • Owner (name / account ID)
  • Renter (name / account ID)
  • Renter driver's license no. / state
  • Trailer (year, make, type)
  • VIN / plate
  • GVWR / max payload
  • Rental period (start–end)
  • Rate ($ per day / week / month)
  • Total rental charges
  • Security deposit (if required by Owner)
  • Pickup / return location

1. Rental and Term

Owner rents the Trailer to Renter for the period above. Late return incurs a fee of 1.5× the daily rate per day plus reasonable recovery costs. Extensions must be booked through the platform before the period ends.

2. Payment and Deposit

All charges are processed through the platform. Any security deposit is set by the Owner in this Agreement and arranged directly between the parties — the platform does not hold deposit funds. It may be claimed only for documented damage, loss, cleaning, tolls, citations, or late fees under this Agreement, supported by the booking’s photo record. For rentals longer than 7 days, Renter authorizes periodic re-authorization of the hold.

3. Condition Documentation

Both parties must complete the platform photo walk-around at pickup and at return, documenting all sides, tires, hitch/coupler, lights, interior (if enclosed), and existing damage. The pickup record is conclusive evidence of condition at handover absent manifest error. Damage claims must be supported by the return record and filed within 48 hours of return.

4. Permitted Use and Restrictions

  • Only the Renter and additional drivers listed on the booking, each licensed and 21+, may tow the Trailer.
  • Loads must not exceed the GVWR/payload above and must be secured to DOT standards.
  • No hazardous materials, illegal cargo, passengers, or livestock (unless the listing expressly permits livestock).
  • No use outside ________, off-road use, subletting, re-listing, commercial use contrary to the listing, or towing with an inadequately rated vehicle or hitch (minimum class stated in the listing).

5. Renter Insurance Warranty

Renter warrants that Renter's automobile liability insurance extends to the towing of this Trailer, or that Renter has obtained coverage that does, and Renter has provided carrier and policy number through the platform. Renter remains liable for damage regardless of insurance status except to the extent a protection plan applies.

6. Protection Plan

If a protection plan was elected at checkout, its terms govern covered damage to the Trailer, subject to its deductible and exclusions. Plans do not cover liability to third parties, bodily injury, cargo, or damage from prohibited use.

7. Maintenance, Breakdown, and Roadside

Owner warrants the Trailer is roadworthy at pickup (tires, bearings, lights, brakes where fitted, current registration). Renter must stop use and notify Owner and the platform immediately upon malfunction. Owner is responsible for mechanical failure not caused by Renter; Renter is responsible for damage from misuse, overloading, or negligence, including tire damage from road hazards unless a plan covers it.

8. Tolls, Tickets, and Impound

Renter is responsible for all tolls, citations, fines, and impound charges incurred during the rental period and authorizes capture against the deposit, plus a $[25] processing fee per item.

9. Loss, Theft, and Total Loss

Renter must report theft to police and the platform within 24 hours. Absent an applicable protection plan, Renter is liable up to the Trailer's fair market value of $________, plus reasonable loss-of-use at the daily rate (capped at 30 days).

10. Indemnification and Hold Harmless

Renter shall indemnify, defend, and hold harmless Owner from third-party claims, damages, fines, and expenses arising from Renter's possession, use, loading, or towing of the Trailer during the rental period, except to the extent caused by Owner's gross negligence, willful misconduct, or breach of the roadworthiness warranty in Section 7.

11. Owner Disclaimers

Owner is not liable for damage to or loss of Renter's cargo or tow vehicle, or for Renter's lost profits, delay, or consequential damages. Nothing in this Agreement excludes liability that cannot be excluded by law.

12. Default

Failure to return the Trailer within 24 hours of the period end without an approved extension is a default; Owner may report the Trailer stolen and recover it, and Renter is liable for recovery costs.

13. Disputes

Disputes are handled first through the platform resolution process, then per the arbitration provision of the Terms of Service. This Agreement is governed by the laws of the state where the Trailer is picked up.

Signatures. The parties sign electronically through the platform; the platform’s e-signature record (name, account, timestamp, IP) is binding under the E-SIGN Act and applicable state law.

Owner and Renter signature blocks are completed in the per-booking copy of this agreement.
